These Terms of Service ("Terms") are an agreement between you and HotPatch Studio Inc. ("HotPatch Studio", "we", "us"), a company incorporated in Canada. They govern your use of the Kairon mobile application and its related services (together, "Kairon").
By creating an account or using Kairon, you accept these Terms. If you do not accept them, do not use Kairon. Our Privacy Policy explains how we handle your information and forms part of this agreement.
You must be at least 13 years old to use Kairon, and at least 16 if you are in the European Economic Area or the United Kingdom. By using Kairon you confirm that you meet the applicable age requirement and that you are able to enter into this agreement.
You need an account to use Kairon. You can create one with an email address and password, or by signing in with Google or Apple.
Everything you create in Kairon — your goals, tasks, habits, reflections and notes — is yours. We claim no ownership of it.
You grant us only the narrow permission we need to run the service: to store your content, transmit it between your devices, back it up, and display it back to you. This permission exists solely to operate Kairon for you. We do not publish your content, share it with other users, sell it, use it for advertising, or use it to train machine-learning models. It ends when you delete the content or your account.
You are responsible for the content you create, and you confirm you have the right to store it in Kairon.
Kairon is a personal planning tool. You agree not to:
Kairon's core planning features — goals, milestones, sprints, tasks, habits, reflections, reminders and the basic widget — are free to use, with no limits on how many you create and no advertising.
We will not move a feature that is free today behind a paid unlock. Paid features are additions on top of the free app, never subtractions from it.
The Supporter unlock is an optional one-time purchase. It is not a subscription: there is no recurring charge, no renewal and nothing to cancel. It gives you access to the Supporter features available at the time of purchase, and to Supporter features we add later, for as long as Kairon operates.
Your Supporter status is tied to your Kairon account, not to a single device, so it follows you when you sign in elsewhere. You can restore it on a new device using Restore Purchases.
Tips are optional one-off payments in small, medium and large amounts. They are a way to support continued development if you want to, and you may leave them as often as you like.
Tips unlock nothing. They do not grant Supporter status or any feature, and they carry no expectation of anything in return.
We may add to the Supporter features over time. We may also change or retire an individual Supporter feature — for example if a third-party service it depends on shuts down — but we will not remove Supporter access as a whole from someone who has bought it, and we will not reduce the free app to make the paid one look better.
We aim to keep Kairon running and available, but we do not guarantee uninterrupted service. We may need to suspend it temporarily for maintenance, updates or technical reasons.
We may change, add or remove features as the app develops, subject to the commitments in sections 6 and 7.4. If we ever discontinue Kairon entirely, we will give reasonable advance notice and a way to export your content before it becomes unavailable.
You may stop using Kairon at any time and delete your account from Settings → Delete Account. Deletion removes your account and content as described in the Privacy Policy, and cannot be undone. Purchases are not refundable on account deletion — refunds are a matter for Apple or Google under section 7.3.
We may suspend or terminate your account if you materially breach these Terms — particularly section 5 — or if we are required to by law. Except where a serious breach or a legal requirement makes it impossible, we will give you notice and an opportunity to put things right first.
Sections 4, 10, 11, 12 and 14 survive the end of this agreement.
Kairon is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Kairon is a planning tool. It is not professional advice of any kind — medical, psychological, financial or otherwise — and should not be relied on as a substitute for it.
We keep backups as described in the Privacy Policy, but we do not guarantee that content can always be recovered. Keep your own copy of anything you cannot afford to lose.
If you are a consumer, nothing in these Terms removes or limits rights that the consumer law of your country gives you and that cannot be waived by agreement.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost opportunities, arising out of your use of Kairon.
Our total liability arising out of or relating to Kairon is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty Canadian dollars (CAD 20).
These limits do not apply to liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or under consumer-protection law that applies to you.
You agree to indemnify us against claims, losses and reasonable costs arising from your unlawful use of Kairon or your breach of these Terms. This does not apply to the extent the claim arises from our own acts or omissions, and it does not apply if you are a consumer where the law does not permit it.
You obtained Kairon from Apple's App Store or Google Play, and your use of it is also subject to that store's terms.
This agreement is between you and us alone. Apple and Google are not parties to it and are not responsible for Kairon or for supporting it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If Kairon fails to conform to any applicable warranty on iOS, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation in respect of Kairon.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Ontario have jurisdiction over any dispute, and you and we submit to that jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, or of your right to bring proceedings in your local courts.
We may update these Terms as Kairon develops. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use Kairon after that means you accept the updated Terms. If you do not accept them, you may delete your account.
